The platform of the company Ontano Travel s.r.l. is an online platform reseller of maritime tickets of the most important Shipping Companies operating as their intermediary. Ontano Travel s.r.l. is not a maritime carrier and does not provide transportation services, therefore the prices and services displayed on the platform are provided directly by the Shipping Companies. The internet service of Ontano Travel s.r.l. is provided and managed by the company ……. with registered office in….. – ……. (….).

1.1 All bookings made through our site or by Call Center are subject to the Conditions below. By accessing our services and site, you confirm that you have read, understand and agree to the following Terms and Conditions. The client, by entering the booking request, reads, can download and declares to accept the terms and conditions of sale of Ontano Travel s.r.l. and the terms and conditions of sale and transportation of the chosen shipping companies, the contents of which are made available from our site and must be similarly accepted before the booking is confirmed. The client also receives, as well, a copy of these conditions of sale by e-mail on the mailbox indicated in the reservation, whether the reservation was concluded via the web or over the phone with an operator.
1.2. The customer may enter booking requests online 24 hours a day or contact the Call Center by telephone during opening hours. Except in cases of force majeure or unforeseen events that cannot be avoided by the Company and as such cannot be attributed to it, Ontano Travel s.r.l. will process booking requests received by it within 48 business hours, excluding holidays and public holidays.
Ontano Travel s.r.l. confirms all reservations based on the requests made by the client, even if it receives the same request more than once; in this case, cancellation of one or more reservations is subject to penalty and fixed reservation fees and the cost of any cancellation coverage purchased will be retained.
Ontano Travel s.r.l. reserves the right to make the acceptance of booking requests subject to the verification of the availability and rates of the shipping companies at the time of confirmation, also may reserve the right not to proceed with the confirmation of the booking if it considers prudently insufficient time for the issuance and delivery of the ticket to the client in its sole interest.
In this case, Ontano Travel s.r.l. is only obliged to refund the amounts collected, which it will repay to the client through the same payment method used for the reservation.
1.3. The departures and fares offered by Ontano Travel s.r.l. are the official ones of the Shipping Companies. Ontano Travel s.r.l., as an intermediary, does not intervene in any way on the rates issued by the Companies but applies a booking fee as compensation for the administrative costs of handling the file.
The Shipping Companies have the right to vary and adjust their fares at any time and without notice until the final issuance of the ticket. However, in exceptional cases, following the issuance of the ticket, the client may be notified directly by the Company of rate changes (e.g. due to increases in fuel costs) or changes on routes, dates, departure and/or arrival times of ferries or the use of other carriers.
Ontano Travel s.r.l. is not responsible for controlling the prices and rates applied to the proposed trips as well as disclaims any responsibility regarding the provision of services booked through its platform, as the same are directly managed by the ferry carriers and subject to their Terms and Conditions.
All services shown are available and bookable through Ontano Travel s.r.l., which facilitates price comparisons and bookings with the maritime operators, excluding any obligation to the user in relation to the management and provision of the transportation service. Therefore, you should make sure you read and understand the Terms of Sale and Carriage of your chosen shipping company.
1.4. For its part, Ontano Travel s.r.l. has the right to use the best rates in the best interest of the customer, applicable at the time of ticket issuance and arising from any offers or promotional rates , even if the application of such particular rates would result in the inability to refund and/or change the ticket in accordance with the Conditions of Sale of the booked Maritime Company.
1.5. Reservation requests are accepted by Ontano Travel s.r.l. up to the day of departure in the event that the customer can make payment by credit/prepaid card and can receive the ticket by e-mail, Whatsapp, text message or other means that allow it to be shown at boarding.
1.6. The customer is solely responsible for the accuracy and truthfulness of the data provided at the time of booking, (routes, dates and times requested; number, age, names and data of passengers; pets; type of accommodations; type and size of accompanying vehicles; e-mail address; telephone number; credit card data; etc.).
The client is also obliged to inform and update himself/herself in advance with the competent Authorities, for all passengers on the travel ticket, about the documents required to make the trip (e.g. identity card, passport, consular visas, permits and health certifications for the transport of animals, etc.) and the requirements for staying at the booked destination (e.g. limitations on disembarkation and/or vehicle movement provided by municipal regulations/ordinances or by the legal regulations in force in the municipalities/countries of the chosen destination locations). As Ontano Travel s.r.l. cannot guarantee the constant updating of local regulations, it is not held responsible for the client’s failure to possess documents or requirements requested by the Authorities. In any case, reference is made to the provisions of current regulations regarding limitations and access and to the conditions of sale applied by the Maritime Companies.
1.7. The submission of the reservation request from the platform Ontano Travel s.r.l. does not imply the automatic assignment of the seat on board and the simultaneous issuance of the ticket, but constitutes a mere reservation request subject to our verification of availability and prices.
1.8. Users may use our site to make reservations and purchases for themselves and/or other persons by whom they have been legally authorized. The customer making the reservation on site or through Call Center shall have the authorization to confirm the same on behalf of all other passengers and is responsible for protecting all personal information provided, ensuring its completeness and correctness.
1.9. The customer traveling with an accompanying pet is required to make a reservation for the pet as well and include it in the ticket. The customer is responsible to inquire in advance about the possibility of animal transportation and compliance with the regulatory standards of the countries concerned. The customer undertakes to verify the regularity of the veterinary certification and health booklet and is obliged to ascertain the actual purchase of services for animals on board where provided (by way of example, cabins with animal access, kennels on board), being responsible for the purchase made. In any case, please refer to the Terms of Sale and Conditions of Carriage of the individual shipping companies concerned, which regulate the matter in detail.
2.1. Ontano Travel s.r.l. allows you to make reservations for commercial vehicles and drivers by submitting a request for quotation from the dedicated Freight and Cargo Transport Area or by contacting the Call Center.
The transportation of goods and commercial vehicles is subject to different and specific conditions of sale and transportation governed by the provisions in use by individual carriers as well as by the current legal provisions, which the shipper declares to know and accept when purchasing the service. It is the shipper’s duty to ensure that he/she is familiar with these General Terms and Conditions using ordinary diligence.
2.2. Special rates determined by each sea carrier concerned shall be applied to cargo reservations.
2.3. Ontano Travel s.r.l. gives the Maritime Carrier the transport assignment as stated in the contract on behalf of the Carrier, who, through its drivers or company employees, delivers the cargo to the Carrier, taking care of its embarkation and related activities and assuming responsibility for the booked services and the declared cargo/freight.
2.4. The balance of the freight, including commission due to Ontano Travel s.r.l., must be paid prior to confirmation of the reservation. Reservations are considered confirmed upon receipt of payment and the sending of the reservation summary containing the details and details of the voyage, as well as the embarkation declaration for the collection of the bill of lading at the port.
The price of transportation is calculated on the basis of the rates in effect at the time of purchase, which are subject to possible change by the shipping company prior to the departure date, in which case the final price to be paid will include the actual freight and commission due to Ontano Travel s.r.l. for the brokerage service.
Ontano Travel s.r.l. shall invoice on a monthly basis on the basis of the statement received from the shipping company. In the event of discrepancies between the price already paid by the Loader and the price actually to be paid on the basis of the bill of lading issued, Ontano Travel s.r.l. reserves the right to obtain a rate supplement up to the amount of the credit. To this end, the Loader authorizes Ontano Travel s.r.l. to withdraw the amount still owed from the credit card entered during payment, the data of which will be retained for this exclusive purpose until the service is completed.
2.5. It is the responsibility of the person making the reservation to ascertain whether or not the vehicle concerned falls into the category of a commercial vehicle, i.e., specifically approved for transporting goods or transporting commercial goods or transiting for commercial purposes.
In fact, the shipper, when making the reservation, will have to communicate the correct measurements, type, and license plate of his vehicle as well as whether he is transporting dangerous materials or goods. In the event that the commercial vehicle is mistakenly booked as a private vehicle, or in the event of incorrect compilation or declaration of the required data, availability and/or boarding may not be guaranteed by the Carrier, who may decide to charge the full fare and deny boarding without reimbursement, or proceed with the contract of carriage, subject to the right to demand payment of the relevant fare differences, taxes, penalties, if any, and related fees, which must be paid to Ontano Travel s. r.l. when the invoice is sent on the basis of the bill of lading actually issued.
Ontano Travel s.r.l. shall not be held liable in the event that the carrier denies boarding of the vehicle or cancels the validity of the ticket due to discrepancies on the bill of lading for reasons attributable to the Shipper.
The Shipper accepts responsibility for the reservation made.
2.6. In the event of cancellation of the booking or non-departure due to the Carrier’s fault, where the carrier provides for the refund of the ticket, Ontano Travel s.r.l. will proceed to refund the amount paid, except for booking fees and net of handling and administrative costs of the file.
2.7. Under no circumstances will Ontano Travel s.r.l. be held responsible for the provision of the transportation service or its operational management.
2.8. Ontano Travel s.r.l. shall not be held responsible in the event that the chosen Carrier changes or cancels routes, dates/times of departure and/or arrival or uses other carriers or other ships/hydrofoils than those originally booked and shall not be liable for any consequential damages or losses caused by the missed departure or change thereof, since the intermediary from which the ticket was purchased, the cost of unused stays, missed connections or additional expenses incurred due to missed departure cannot be attributed to the intermediary.
Ontano Travel s.r.l. is only responsible for losses that result directly from its intermediary activity as well as from the violation of these general conditions.
3.1. Reservations are considered confirmed upon issuance of tickets and such issuance is always subject to receipt of payment. Ontano Travel s.r.l. is never and under no circumstances responsible for any fare increases and/or seat unavailability of shipping companies. In cases of seat unavailability and/or fare changes not accepted by the client, Ontano Travel s.r.l. is only obliged to refund any sums already collected.
3.2. Although the prices and rates proposed by Ontano Travel s.r.l. are up to date and accurate, it is not possible to guarantee the client from any tariff adjustment required by the Shipping Companies, therefore Ontano Travel s.r.l. reserves the right to update the booking quotes before the ticket is issued, in each case subject to confirmation by the client. Ontano Travel s.r.l. contacts the client to propose possible travel alternatives. In the event that the client does not accept the proposed travel alternatives, it shall immediately proceed to re-credit the client in full with the amounts already collected.
3.3. The method of payment is selected by the customer while filling out the reservation request, where, according to the choice, the details and instructions for making the balance are given. Tickets departing within 5 business days from the date the reservation request is sent must be paid for by credit card or Paypal. Payment by credit card is accepted only if the cardholder is one of the passengers or the reservation applicant.
3.4. For reservations for which the payment method chosen is bank transfer or postal bulletin, the client is required to forward to Ontano Travel s.r.l., by fax, e-mail, Whatsapp, or in the user area, the copy of the payment. Please note that, in such cases, the ticket is sent to the client only after verification of the actual crediting to the bank or postal account of Ontano Travel s.r.l. The verification is carried out by one of our operators, therefore, in the case of forwarding the document during the hours when the accounting office is closed, Ontano Travel s.r.l. is not responsible for changes in estimates or availability that have arisen by the time the credit check has been made.
3.5. Following payment, Ontano Travel s.r.l. will issue a booking confirmation notification that presents travel details and details, as well as all relevant information. This notification does not constitute a valid ticket for boarding, but merely a summary of the reservation. Tickets are sent along with the confirmation email and must be specially downloaded by the customer. If the customer does not receive the tickets within 48 hours of confirmation, he/she should contact the Call Center or access his/her Reserved Area and forward the request for dispatch. In any case, Ontano Travel s.r.l. proceeds to send the ticket code by text message to the telephone number provided during the booking process in order to proceed in case of urgency to print at the port ticket offices.
3.6. Ontano Travel s.r.l. is not responsible for any interruption of the site or unsuccessful transactions for reasons not attributable to it. In any case, the customer may contact the Call Center to change the chosen method of payment.
4.1. Travel documents are sent to the customer by e-mail (as an attachment or via a link). In case of non-receipt of tickets, the customer is required to contact Ontano Travel s.r.l. and request them again.
Any shipments by mail or by courier expressly requested by the client with costs to be borne by the client shall be made in the name and on behalf of the client. Ontano Travel s.r.l. declines all responsibility for any delays in delivery or non-delivery or partial delivery of travel documents due to causes not attributable to it.
4.2. Upon receipt of the travel documents, the customer is obliged to compulsorily and meticulously check the correctness of the data on them. Any errors and/or inaccuracies must be communicated immediately as late communications will invalidate any possible responsibility of Ontano Travel S.R.L
4.3. It is compulsory to present oneself for boarding with the travel documents within the terms stipulated in the shipping companies’ conditions of carriage. Otherwise, the passenger loses the right to board and/or is required to purchase the ticket again. Under no circumstances shall Ontano Travel s.r.l. be held responsible for delays or failure to produce tickets, even partial, at the time of embarkation for reasons not attributable to it.
The customer is also required to present at boarding the appropriate identity documents to reach the destination (identity cards, passports, visas, etc.) for all passengers booked. This provision shall also apply to accompanying vehicles and/or animals.
4.4. Any page printed from this website, other than tickets or vouchers for presentation at boarding, does not constitute confirmation of a reservation, let alone a valid document for boarding.
5.1. All requests for change or cancellation of reservations must be submitted by email to the company. Requests for changes or cancellations received in a manner other than indicated that does not allow the timeliness of the action to be guaranteed will not be accepted. In any case, Ontano Travel s.r.l. is not responsible for delays or processing of requests received by methods other than those indicated.
In case of need during the hours or days when Ontano Travel s.r.l. is closed or if the service is unavailable for any reason, the client may contact the booked shipping company directly and request changes and cancellations from it.
5.2. In the case of changes or variations to tickets already issued, if under the terms of the regulations of the Shipping Company concerned these are contemplated, the customer is required to pay the variation penalties provided for in the General Conditions of Carriage of the Company itself as well as to pay to Ontano Travel s.r.l. the reopening and practice management expenses from a minimum of € 5.00 up to a maximum of € 40.00 for each change or modification. Changes or variations made within 24 hours of confirmation of the reservation do not entail the aforementioned reopening and practice management expenses on our part, without prejudice to any penalties applied in each case by the shipping carriers.
5.3. In case of cancellation and/or non-use of tickets already issued, the customer is still required to pay in full or in part according to the General Conditions of Carriage of the Companies involved in his or her reservation.
Any partial refunds are always subject to and regulated by the General Conditions of the Companies involved and subject to the reopening and practice management fees due to Ontano Travel s.r.l., equal to 15% of the ticket amount. Under no circumstances are booking fees and cancellation coverage that may have been purchased reimbursed.
5.4. It is the customer’s responsibility to check whether the purchased ticket allows for variation and/or cancellation as well as refund under the conditions of sale imposed by the ferry operator. Promotional or special fare tickets may not be refundable.
Refunds are always made in accordance with the conditions of sale of the shipping company concerned.
5.5. Sometimes, following cancellation, the Shipping Companies may legitimately provide an alternative form of reimbursement consisting of the issuance of a voucher of equal value to the travel ticket purchased to be used within the timeframe and in the manner indicated in the information notice sent with the same. Ontano Travel s.r.l., as an intermediary in the sale of tickets on behalf of the same Companies, is bound by the terms established by them and cannot in any way control the reimbursement methods operated and of which it is the spokesperson.
5.6. In the case of sending requests for changes to previously purchased tickets during the hours and days when the offices of Ontano Travel s.r.l. are closed (hours from 8:00 p.m. to 8:00 a.m. and days of December 25 and January 1), the latter will check the price and availability of the new quote on the day following the sending of the request.
In the event that at the time of verification of the quote Ontano Travel s.r.l. finds unavailability of seats or price changes established by the Maritime Company, it will not proceed to change the tickets and will contact the Customer to agree on possible solutions.
5.7. Ontano Travel s.r.l. has no responsibility for any agreements, changes or variations made by client directly with the Shipping Company
5.8. Shipping companies are responsible for the provision of the transportation service that they manage directly. Ontano Travel s.r.l., as retailer and intermediary, is in no way responsible for the management of embarkations and departures or for damages caused by variations or management thereof.
Impediments to travel attributable to the carrier, such as impediments to departure or its cancellation, changes in service or itinerary, delays or interruptions of travel due to adverse marine weather conditions, or other causes attributable or not attributable to the carrier, shall in no event result in liability on the part of Ontano Travel S.R.L
In the event of a trip cancellation, the shipping company is required to refund the passenger the amount of the purchased ticket or offer a useful alternative, subject however to acceptance by the customer in accordance with European regulations (as reported on the websites of the individual companies). Reimbursement only concerns the portion of the ticket actually unused, i.e., the ride affected by the cancellation or change made by the carrier itself. Ontano Travel s.r.l., for its part, will endeavor to ensure correct information for the client where it becomes aware of it and to handle the change and refund paperwork, in any case making the refund of the amount collected subject to actual reimbursement by the Company.
6.1. Amounts charged and subsequently re-credited by Ontano Travel s.r.l. to the customer’s credit card may not be made immediately available by the card operator.
In such cases, only the cardholder, as the sole interlocutor with his or her credit institution, may request the manager to restore the amount to his or her card’s ceiling in advance. The timing of plafond restoration may vary according to the terms of the manager.
6.2. In case of payment in excess of the amount due for the reservation, made by bank transfer or postal bulletin, Ontano Travel s.r.l. will refund the difference.
6.3. In the event of cancellation or change of tickets, Ontano Travel s.r.l. will reimburse the client for any sums due, less any penalties imposed by the Company concerned as well as any management fees due to Ontano Travel s.r.l. as specified above, always and in all cases making reimbursement conditional on receipt of the sums by the Maritime Company.
6.4 Unless otherwise agreed, Ontano Travel s.r.l. reimburses the client with the same method of payment through which the client settled the reservation at the time of purchase.
6.5. In the event that a shipping carrier offers a voucher for a cancelled voyage in lieu of monetary reimbursement (see section 4.5.), Ontano Travel s.r.l. may issue only said voucher, which may be redeemed by the client in accordance with the conditions established by the shipping company.
7.1. The customer is given the option to purchase an additional cancellation coverage guarantee to ensure reimbursement of any penalties that may be due in the event of cancellation of services purchased through the site for the specific causes and instances covered therein.
7.2. The guarantee must be selected and purchased at the time of booking and can be added up to 24 hours after purchase. Coverage is active from the time of purchase until the first service purchased is used. In the case of multiple trips booked, the guarantee option must be selected for all services.
7.3. Coverage against cancellations cannot be removed after its purchase and is non-refundable.
7.4. In case of changes to the reservation there will be price adjustment also of the guarantee of coverage against cancellations in the percentage amount of 6% of the fare difference for the purchase of the new service.
8.1. Ontano Travel s.r.l., as an intermediary between the client and the supplier (shipping companies and carriers), is not responsible for the booked trip and disclaims any responsibility for the provision of the transportation service and its operational management.
8.2. Ontano Travel s.r.l. shall not be held liable in the event that the Shipping Company denies boarding to one or more booked passengers, requests an adjustment of the ticket or cancels its validity due to discrepancies between the data that the customer entered during booking and the documents of passengers and vehicles that are presented at the time of boarding or during check-in.
8.3. Ontano Travel s.r.l. shall not be held liable in the event that the booked shipping company changes or cancels routes, dates/times of departure and/or arrival or uses other carriers or other ships/hydrofoils than those originally booked. Ontano Travel s.r.l. shall not be liable for any consequential damages or losses caused by the missed departure or variation thereof, since the intermediary from whom the ticket was purchased, the cost of unused stays, missed connections or additional expenses incurred due to the missed departure cannot be blamed.
8.4. Ontano Travel s.r.l. shall not be held responsible for interruptions or technical malfunctions of the booking system not attributable to it and related software.
8.5. Ontano Travel s.r.l. is not responsible for information that is not published on its site, but can be found from the general conditions of the companies for which it acts as an intermediary and made available by the platform as well as when confirming the booking.
Ontano Travel s.r.l. disclaims any responsibility for the non-publication on its site of the extraordinary conditions applied by the Companies in emergency situations, for which the customer is required to independently and with due diligence to inform themselves through the appropriate channels.
8.6. Ontano Travel s.r.l. is responsible only for losses that result directly from its intermediary activity as well as from the violation of these general conditions.
8.7 The customer is responsible to Ontano Travel s.r.l. and the booked shipping company for compliance with the terms and conditions of sale and any other requirements imposed by the shipping carrier or by law. It is the client’s duty to ensure that he/she is familiar with these General Terms and Conditions using ordinary diligence.
The customer accepts his or her financial responsibility for all transactions made in his or her own name and warrants that the information provided concerning his or her person and relatives and passengers is true and correct.
8.8. The client acknowledges and accepts that Ontano Travel s.r.l. acts as an intermediary between the client and the Maritime Company and assumes no responsibility for the failure or inaccurate provision of services offered by the Company.
9.1. The Consumer Code, Legislative Decree 06/09/2005 No. 206, G.U. 08/10/2005, as amended by L. May 3, 2019 No. 37 and L. April 12, 2019 No. 31, in Article 59 “Exceptions to the right of withdrawal” provides: “The right of withdrawal referred to in Articles 52 and 58 for distance and off-premises contracts is excluded with respect to: … n) provision of accommodation for non-residential purposes, transportation of goods, car rental services, catering services or services concerning leisure activities if the contract provides for a specific date or period of performance.” in accordance with Directive 2011/83/EU on consumer rights, Chapter III Article 16 and implemented by Legislative Decree 21/02/2014 No. 21.
The purchase of maritime transportation services falls squarely within leisure contracts having a specific date, which means that for such contracts concluded through our platform the right of withdrawal is excluded.
10.1.The purchase of tickets and travel tickets through Ontano Travel s.r.l. falls within the scope of indirect electronic commerce, which is similar to mail-order sales and, therefore, not subject to the invoice requirement (unless requested by the customer at the same time as the purchase of the travel ticket and only where issuance is possible) as provided for in Article 22 of Presidential Decree No. 633 of 1972, nor to the requirement of certification by means of a receipt or fiscal receipt, (pursuant to Article 2, paragraph 1 letter oo) of Presidential Decree No. 696 of 1996.The consideration for the sale is recorded in the register of receipts kept by the company.
11.1. This site and the content therein, such as the name “Ontano Travel s.r.l.” and other trademarks and logos displayed on the site, are registered trademarks and the property of Ontano Travel s.r.l. which holds the license and are therefore protected by copyright. The trademarks of the Companies are their property and Ontano Travel s.r.l. is authorized to publish them. The above content may not be copied, reproduced, republished, downloaded, transmitted or distributed without the written consent of Ontano Travel s.r.l. Users may use the content of this site for personal and non-commercial purposes.
12.MODIFICATION TO THE TERMS AND CONDITIONS
12.1. Ontano Travel s.r.l. reserves the right to modify or update the conditions relating to the use of the site as necessary and for justified reasons and operational needs, without prior notice to users. Use of this site subsequent to any modification of the conditions constitutes acceptance of the same.
13.1. For any dispute originating from the interpretation and/or execution of this contract, the exclusive place of jurisdiction is Naples. In the case of a passenger who has the status of consumer under current Italian law, the court of residence or domicile of the same, if domiciled or resident in Italy, shall have exclusive jurisdiction.
